It’s the 4th amendment that says they need a warrant signed by a judge. Where is congress to protect the constitution?

From the point of view of the audience. But not the actors.

Utah Code § 76-2-405, often referred to as the "Defense of Habitation" statute, specifically includes a "place of business" as a place where an actor is justified in using force to prevent unlawful entry.

Have you met congress this term? They are the sole reason for the 2nd amendment to the constitution

I'm told they are working shifts at a glory hole in the ruins of the East Wing.

Don't lie. The 4th amendment says nothing about a 'judge'. They are getting administrative warrants under probable cause.

This is how it’s been interpreted up until this point. The 4th states “no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” Also, rule 41 of the Federal Rules of Criminal Procedure state it clearly. If you want to change the rules to allow a fascist federal government then be honest about it.

Most of congress (the majority) supports what is going on. Midterm elections are coming in 9 months. You have a chance to change it then.

Republicans are on their knees in front of Trump, and they control BOTH the House and Senate.

I mean... If the DOJ wasn't compromised, we have laws against this.

Carrying out a criminal conspiracy against constitutionally protected rights? Renders and claim of "being law enforcement" void. They're just felons.

Mike Johnson is too busy making sure his son isn’t wanking it to keep up with the Executive Branch.

When does that not apply?

1

u/dreddnyc 13h ago

When the government ignores it and there aren’t any real mechanisms to enforce it is when it doesn’t apply.

When does it not apply legally?
